WingJockey Terms of Service

Welcome to WingJockey. These Terms of Service (“Terms”) govern your access to and use of the WingJockey website, mobile applications, and related services (collectively, the “Service”) operated by Wing Jockey LLC (“WingJockey,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of the Service

WingJockey is a digital aviation platform and community designed to help pilots and aviation enthusiasts discover flights, track flying activity, learn from their experiences, connect with others, and participate in aviation-related experiences and content.

Features of the Service may include, without limitation:

  • flight tracking, replay, and visualization;
  • flight activity logs and related records;
  • airport discovery, maps, and related aviation content;
  • social features, profiles, posts, comments, and community participation;
  • training tools, summaries, and educational resources;
  • AI-generated insights, summaries, or assistance; and
  • digital rewards, points, achievements, and similar gamified features.

WingJockey may add, remove, suspend, modify, or discontinue any feature, functionality, or portion of the Service at any time, with or without notice.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that you are legally able to enter into these Terms.

WingJockey is intended for pilots, student pilots, aviation enthusiasts, and others with a legitimate interest in aviation. We reserve the right to deny access to any person or entity at our discretion.

3. Accounts and Verification

To use certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your information updated.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity that occurs under your account; and
  • promptly notifying us of any unauthorized access or suspected security breach.

WingJockey may require verification of pilot or student pilot status for some users or features. We may suspend, restrict, or terminate accounts that provide false, misleading, incomplete, or unverifiable information.

4. Free and Paid Membership

WingJockey operates a freemium model. Some features are available at no cost, while other features, content, tools, or benefits may require a paid subscription or membership (“Membership”).

We may determine, in our sole discretion, which features are included in free accounts and which features are reserved for paying members. We may change, move, limit, or remove features from any tier at any time.

Membership in WingJockey is a privilege, not a right. We reserve the right to refuse, suspend, or revoke membership or access to the Service at any time in accordance with these Terms.

5. Subscriptions, Billing, and Auto-Renewal

Paid subscriptions may be offered on a monthly, annual, or other recurring basis. If you purchase a subscription through the Apple App Store or another third-party platform, your purchase is subject to that platform’s billing terms and policies in addition to these Terms.

Unless otherwise stated, subscriptions automatically renew at the end of each billing period unless canceled before renewal.

If you subscribed through Apple, you must manage or cancel your subscription through your Apple account settings. WingJockey cannot cancel App Store subscriptions on your behalf.

Refunds, credits, and billing disputes are handled according to the policies of the platform through which you purchased your subscription, unless otherwise required by law.

We reserve the right to change pricing, features, or membership benefits at any time. Where required, we will provide notice before pricing changes take effect.

6. Community Standards and Acceptable Use

WingJockey is designed to foster a positive, respectful, and safety-conscious aviation community. You agree to use the Service in a lawful, respectful, and responsible manner.

You may not use the Service to:

  • harass, intimidate, threaten, stalk, or abuse any person;
  • post or transmit hateful, obscene, defamatory, or otherwise offensive material;
  • impersonate another person, pilot, business, or organization;
  • falsify flight activity, qualifications, certifications, airport information, or other records;
  • promote unsafe aviation practices or knowingly provide misleading aviation information;
  • post spam, affiliate links, unauthorized promotions, solicitations, or self-promotion without our prior written permission;
  • engage in illegal activity or encourage others to do so;
  • upload malicious code or interfere with the operation or security of the Service; or
  • use the Service in a way that harms WingJockey, its users, or the integrity of the community.

We may suspend or terminate accounts, remove content, restrict features, revoke Membership, or deny access to the Service if a user violates these Terms or engages in conduct that we determine, in our sole discretion, is abusive, disruptive, unsafe, misleading, harmful, or inconsistent with the values, safety, integrity, or intended purpose of the platform.

This includes users who are repeatedly hostile, aggressive, disrespectful, inflammatory, or otherwise a poor fit for the community, even if their conduct is not specifically listed above.

Decisions regarding moderation, membership status, and account restrictions are made in our sole discretion and may be made with or without prior notice.

7. Content Moderation and Removal

WingJockey reserves the right, but not the obligation, to review, monitor, edit, remove, refuse to publish, restrict access to, or preserve any content submitted to or appearing on the Service.

We may take such action at any time and for any reason, including if content is, in our sole discretion:

  • in violation of these Terms;
  • misleading, inaccurate, or unverifiable;
  • unsafe or likely to create aviation-related confusion or risk;
  • disruptive to the community;
  • harmful to users, WingJockey, or third parties; or
  • inconsistent with the integrity, spirit, or intended purpose of the platform.

We are not obligated to publish, host, maintain, restore, or preserve any user-submitted content, and we may remove content or restrict accounts without prior notice.

8. User Content and License

You may submit content to the Service, including without limitation flight activity, GPS traces, replays, photos, videos, comments, debriefs, messages, airport information, profile information, and other materials (“User Content”).

You retain ownership of your User Content. However, by submitting, posting, uploading, or sharing User Content through the Service, you grant WingJockey a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, store, reproduce, modify, adapt, display, publish, distribute, create derivative works from, and otherwise use that User Content for the purpose of operating, improving, promoting, developing, training, and providing the Service.

This license includes the right to use public or shared content for marketing, product development, research, safety review, support, analytics, partnerships, educational materials, and AI-related product improvement.

You represent and warrant that you own or have the necessary rights to submit your User Content and to grant the rights described above.

We may use aggregated, de-identified, or anonymized data derived from user activity, flight patterns, airport contributions, and platform usage to improve the Service and develop new products or features.

9. Aviation Disclaimer: Informational Use Only

WingJockey is not a certified aviation navigation tool, certified flight planning tool, approved aeronautical chart, or FAA-approved source of operational flight information.

The Service is provided for informational, educational, community, and entertainment purposes only. It does not replace official sources, including but not limited to FAA publications, current aeronautical charts, NOTAMs, weather briefings, aircraft documentation, navigation databases, airport publications, or pilot judgment.

You are solely responsible for verifying all information through official and current sources before using it in connection with any flight, preflight planning, aircraft operation, or aviation decision.

10. Aviation Disclaimer: Data Accuracy and Third-Party Sources

The Service may use or display data from third-party providers or external sources, including without limitation GPS data, ADS-B or other tracking-related information, airport information, map data, weather-related information, AI-generated interpretations, community-submitted data, and other aviation-related content.

Such information may be delayed, incomplete, inaccurate, out of date, interrupted, improperly attributed, or unavailable. WingJockey does not warrant the accuracy, completeness, reliability, timeliness, or fitness of any data displayed through the Service.

Any apparent route, position, replay, airport detail, time, status, weather item, or other aviation-related content shown in the Service may differ from actual conditions or official records and must not be relied upon as an authoritative operational source.

11. Aviation Disclaimer: Pilot in Command Responsibility

The pilot in command remains solely and fully responsible for the safe operation of the aircraft, compliance with all applicable laws, regulations, procedures, limitations, airspace requirements, weather minimums, and safe decision-making before, during, and after flight.

Use of the Service does not shift, reduce, or replace the responsibilities of the pilot in command, flight instructor, operator, aircraft owner, or any other aviation participant.

You agree that WingJockey is not responsible for any flight planning decision, operational decision, safety outcome, regulatory compliance issue, enforcement matter, incident, accident, delay, diversion, or loss arising out of or related to use of the Service.

12. No Emergency or Safety-Critical Use

WingJockey is not intended for emergency use, dispatch, traffic separation, terrain avoidance, weather avoidance, collision avoidance, or any other safety-critical or time-critical purpose.

You agree not to rely on the Service in any emergency or urgent operational context where failure, delay, inaccuracy, outage, or missing data could contribute to harm, injury, property damage, or unsafe conditions.

13. AI-Generated Content

Some features of the Service may generate summaries, recommendations, classifications, interpretations, or other outputs using artificial intelligence or automated systems. These outputs may be incomplete, inaccurate, misleading, or inappropriate.

AI-generated content is provided for convenience and informational purposes only and must not be relied upon for operational aviation decisions, safety-critical judgments, legal conclusions, or professional advice.

14. Virtual Rewards, Points, and Digital Items

WingJockey may offer points, badges, achievements, rankings, status markers, streaks, or other digital items or rewards.

These items are part of the Service experience only. They have no cash value, are not redeemable for money, are not personal property, and may not be transferred, sold, or exchanged unless expressly authorized by WingJockey.

We may modify, recalculate, revoke, reset, or discontinue these features at any time.

15. Intellectual Property

The Service, including its software, design, branding, trademarks, logos, text, graphics, compilations, interfaces, and other non-user content, is owned by WingJockey or its licensors and is protected by intellectual property and other laws.

Except as expressly permitted in writing, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, reverse engineer, scrape, or otherwise exploit any portion of the Service.

16. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that we may collect, use, and share information as described in the Privacy Policy.

17. Suspension, Termination, and Deletion

You may stop using the Service at any time. You may request deletion of your account subject to our data retention, backup, fraud prevention, legal compliance, and operational requirements.

We may suspend, limit, disable, or terminate your account, Membership, access to the Service, or access to certain features at any time, with or without notice, for any reason or no reason, including if we believe you have violated these Terms, created risk for the community, or are not a fit for the platform.

Upon termination, licenses granted by you that are reasonably necessary for archived, shared, legal, security, backup, or previously distributed content may survive to the extent permitted by law.

18. Service Availability and Changes

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, availability, uptime, error-free operation, data preservation, or continued support for any feature.

Outages, maintenance, bugs, delays, and service interruptions may occur. We may modify, suspend, or discontinue all or part of the Service at any time without liability.

19. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or reliability.

WingJockey does not warrant that the Service will meet your requirements, that it will be secure or uninterrupted, that any information will be accurate, or that defects will be corrected.

20. Limitation of Liability

To the maximum extent permitted by law, WingJockey, Wing Jockey LLC, and their affiliates, officers, employees, contractors, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunity, aircraft use, or other intangible losses arising from or related to your use of, or inability to use, the Service.

This limitation applies regardless of the theory of liability and includes, without limitation, claims arising from aviation decisions, route selection, airport usage, data inaccuracies, outages, community content, AI outputs, third-party data, safety outcomes, incidents, accidents, or regulatory matters.

To the extent any liability is not excluded, our total liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to WingJockey for the Service during the 12 months before the event giving rise to the claim or (b) one hundred U.S. dollars (US $100).

21. Indemnification

You agree to defend, indemnify, and hold harmless WingJockey, Wing Jockey LLC, and their affiliates, officers, employees, contractors, licensors, and partners from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and attorneys’ fees arising out of or related to:

  • your use of the Service;
  • your User Content;
  • your violation of these Terms;
  • your violation of any law, regulation, or third-party right; or
  • any aviation-related act, omission, decision, or event connected to your use of the Service.

22. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

Before filing a claim, you agree to first contact WingJockey and attempt to resolve the dispute informally by emailing support@wingjockey.com.

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, and not in court. You and WingJockey waive any right to a jury trial.

You and WingJockey further agree that any arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, coordinated, or representative action. You waive any right to participate in a class action or class-wide arbitration.

If any portion of this section is found unenforceable as to a particular claim, the remainder shall still apply to the fullest extent permitted by law.

23. Governing Law

These Terms and any dispute arising out of or relating to the Service or these Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles, except to the extent federal law governs arbitration.

24. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the Service and will become effective as of the stated “Last Updated” date unless otherwise noted.

Your continued use of the Service after updated Terms take effect constitutes your acceptance of the revised Terms.
